Kim A. Smith graduated summa cum laude from the State University of New York at Stony Brook with a B.A. in political science and a minor in journalism. She received her J.D. cum laude from Fordham University School of Law, where she was the Notes and Articles Editor of the Urban Law Journal.
Kim started her career as an associate with the New York City firm of Cahill Gordon & Reindel, LLP in 2003 and exclusively represented a major banking institution from 2012 through 2013. Kim also practiced with other Long Island firms before joining EHA in 2015.
Throughout her career, Kim’s practice has covered a broad range of commercial and general litigation matters, including business dissolutions, contract, real property, and eminent domain disputes. She also represents clients in Surrogate’s Court matters, including contested probate proceedings and contested accountings, and advises clients in connection with disputes involving estates, fiduciaries, and beneficiaries.
In 2026, Kim secured dismissal with prejudice of all claims brought in the U.S. District Court for the Eastern District of New York, together with an award of attorneys’ fees, as a sanction based on the plaintiff’s pervasive use of false and fabricated citations to case law throughout his filings. In 2026, Kim was on the team that secured summary judgment dismissing claims by a real estate broker seeking an unearned commission. In 2023, Kim was on the trial team that obtained a significant monetary judgment on counterclaims for abuse of process while successfully defending claims alleging breach of a right of first refusal concerning valuable Hamptons real property.
Kim lives with her family in Mattituck, New York.
