Planning & Administration

Planning for elder years, death, and succession is often a difficult task.  For over 60 years, EHADP has assisted individuals, couples and families with their estate planning, working with them to create and implement an estate plan that takes into account their personal needs.  Estate plans are customized for clients to address their family relationships, their taxable estate assets, preservation of their wealth, transition of any businesses or family-owned properties, and health and other needs of the clients and their family members.  Our attorneys have maintained long-term relationships with the firm’s clients and often have represented multiple generations of family members.

Whether the clients are young couples, who need to take basic steps protect their spouses and children, or seniors, who have a breadth of assets and decisions to make, our attorneys will help clients sort through the available planning tools, work where appropriate with their accountants and financial advisors, and prepare the necessary documents to achieve their immediate and long-term goals.   Some of the estate planning services offered include:

  • drafting wills
  • creating various types of trusts, including revocable living trusts, irrevocable life insurance trusts, and trusts for gifting purposes
  • preparing living wills, health care proxies and powers of attorney
  • forming family limited partnerships and limited liability companies.

When faced with the death of a loved one, our clients rely on the firm’s compassionate attorneys to assist them in navigating the process of administering the estate.  We represent those nominated as executors in the probate of wills in Surrogate’s Court.  For those who may have passed without a will, EHADP can advise on intestacy proceedings and the transfer of assets to heirs at law.  If a client dies with one or more trusts, we also counsel successor trustees in the further administration and distribution of the trust.  Whether it be probate of a will, intestacy proceedings or administration of a trust, EHADP can assist in all aspects from any required court filings for the appointment of fiduciaries through the accounting of the estate or trust.  Since our attorneys are well-versed in other practice areas that often overlap with estates, such as real estate, corporate and other business transactions, EHADP can competently handle other matters that may stem from a client’s death.
